현재 미국 특허법에서 특허성의 문제가 가장 논란이 되고 있는 분야가 바로 "생명공학특허"이다. 이러한 상황에서 대상판경에서는, 9인의 대법관 전원이 만장일치로 이 사건 특허의 특허성을 부인하였다. 미국 특허법 제 101조에 기초하여 이 사건에서 쟁점이 되는 "치료효과 최적화의 특허성"을 부인한 것이다. 이 사안에 대한 CAFC특허인용판결 및 연방대법원의 특허기각판결은, 수지상 세포사안의 산업상 이용가능성에 대해 이를 인정한 한국의 특허법원 판결(특허법원 2001. 8. 17. 선고 2000허 6307 판결) 및 이를 부정한 대법원판 결(대법원 2003. 3. 14 선고 2001후2801 판결)과 주문의 결론은 물론 이의 논 거로 제시된 판단의 이유까지 매우 흡사하다. 이는 마치 사실심의 특성상 사 안에 대한 구체적인 판단을 통해 합목적성을 추구하는 하급심과 법률심의 특성상 기본 법리에 충실하면서도 법적견해의 변경이 가져올 영향력에 대해서 다소 보수적인 입장을 취하는 연방대법원의 입장을 대변하는 것처럼 보이기도 한다. 그러나 최근 생명공학기술의 발전에 따라 인간의 유전자 구조에 대한 해명 이 진천되고 있고, 이를 이용한 치료기술도 고도화되어 이러한 기술의 개발이 국가의 산업발전 및 경쟁력 향상에 큰 기여를 할 수 있는 것으로 예상되고 있다. 오히려 의료행위 관련 발명에 대한 특허 인정은 연구 및 산업 환경의 급 격한 변화와 맞물려 의료인 및 민간업자에게 발명의 동기를 부여하여 결과적으로는 의료 기술에 더욱 바람직한 발전을 가져올 수도 있는 것이다. 결국 장기적인 의료 기술의 발전을 위해서는 관련 법률의 재정비가 긴요하고 이로 인한 부작용을 막기 위해서 급진적인 변화보다는 단계적인 변화를 요구하게 되는바, 장기적으로는 한국의 특허법 규정에 대한 개정을 목표로 단 기적으로는 이에 대한 법원의 해석을 보다 완화할 필요가 있다고 생각한다 구체적으로 살펴보면, 특허법 제29조 제1항의 ``산업상 이용가능성``에 있어서 ``산업``의 의미를 ``의료산업``을 포함하는 ``광의의 산업``으로 해석하고, ``이용가능 성``의 의미도 ``기술의 범용성``이나 ``발전가능성``까지 포괄하는 개념으로 확장하는 것이 바람직하다고 본다.
The most controversial sector in U.S.A patent law is the ``biotechnology patent`` lately. In this situation, nine Justice of the Supreme Court denied the ``patent eligibility`` unanimously in the target judgement. ``Patent eJigiblility of optimalizing the therapy effect`` is denied based on the U.S patent law code 101. CAFC``S patent pennission judgement and U.S Supreme Court``s conservative patent dismissal judgement in this case are very similar to Korean patent court``s industrial availability permission judgement and Korean Supreme Court``s industrial availability patent dismissal judgement in the perspect of the reason is presented as the basis of the judgement. This is as if the reflection of the lower court``s tendency to seek the purposefulness through the concrete judgement on specific issues as fact-finding proceedings and the Supreme Court``s conservative stance taken because of being faithful to the basic principle of law and fearful about the social influence of the change in legal opinion. However, the explanation for human gene structure has been progressed according to the recent development of biotechnology and it is expected that this can be a major contributor to the industrial development and competitive power enhancement. Rather, the patent permission for medical practice will produce good results because it motivates the invention to the health and medical service personnel, coupled with the rapid changes in the research and industrial environment. As a result, rearrangement of law is necessary for the development of medical technologies and the gradual changes are required rather than the radical change for preventing the adverse effects. So I think we need to aim on revising the Korean patent law in the long run and relax the construction of patent law in the short run. Specifically, industrial availability in the Article 29 subsection 1 of Korean patent law, it is desirable to extend the concept of ``industry`` including the medical industry and the meanings of ``applicability`` covering the ``technological generality`` or the ``development potential``.
