이 글은 현재 우리나라에서 논의되고 있는 장기와 인체조직기증 및 이식에 관한 법체계의 정비에 필요한 비교법적 토대를 제공하기 위한 것이다. 장기 이식과 대조해 보면 인체조직 이식에 관한 독일 법제도를 소개하고 분석한 연구는 아직 우리나라에는 전무한 실정이라고 할 수 있다. 독일의 입법은 그 체계의 완결성과 정교함 때문에 이미 우리 법문화에 많은 영향을 주었으며, 지금도 여전히 비교법 연구에서 매우 중요한 역할을 하고 있다. 인체조직 기증자의 의사를 가장 잘 반영하고, 수혜자에게도 공정성과 안전성을 최대한 보장해 줄 수 있는 정당한 법제도의 모색을 위해 독일법을 검토하는 것은 두 나라가 가지고 있는 사회문화적 배경이나 의료보험체계 등의 상이한 조건에도 불구하고 우리나라 장기 및 인체조직 법체계의 새로운 입법작업을 위해서도 좋은 참조가 될 수 있을 것이다. 또한 이 글은 독일의 인체조직이식에 관한 법규정의 전체적인 그림을 조망하는데 일차적인 목적이 있으며, 인체조직 기증에서 이식까지의 일련의 과정에서 나타나는 법적이고 의료실무적인 모든 내용을 문화인류학적이고 사회적인 관점에서 설명하고 해석하는 것은 이 논문의 범위에서는 불가능하고, 이것은 오히려 광범위한 연구서의 과제라 할 수 있다. 이런 이유로 본문에서는 먼저 독일의 인체조직이식을 장기이식과 관련하여 전체적으로 살펴보고, 그 다음 인체조직이식의 법적 토대가 되는 중요한 두 법률인 <장기와 조직의 기증, 적출 및 이식에 관한 법률>(약칭하여 이식법)과 <의약품 유통에 관한 법률>(약칭하여 의약품법)을 분석하고 있다. 전자에서 규정하고 있는 것은 인체조직의 기증에 관한 동의, 조직기관과 의료공급기관의 인체조직 채취, 검사, 기록, 추적 및 조직의 거래금지 등 법적인 문제에 관한 것인데 비해, 후자에서는 조직채취기관, 검진실검사, 조직이나 조직조제의 처리나 가공에 대한 허가사항 등을 규정하고 있다.

This paper analyses and introduces the legal regulation of human tissue transplantation in Germany, to get a legal comparative basis. Human tissue is today very important element of medical care and can rescue the life of seriously ill people or substantially improve their quality of life. So tissue donation and tissue transplantation wins more and more meaning in the legal regulation as well as in the reality. In Korea there is not enough information about legal regulation of human tissues transplant in Germany. The German judicial system has big influence in Korea and plays a very important role in comparative legal research. Because the German legal system is known as a systematical and well thought-out system. Against this Background this paper tries to introduce two import laws in the area of German tissue transplantation, so German Transplantation Act (TPG), German Pharmaceuticals Act (Arzneimittelgesetz). In the course of the directive 2004/23/EC oft the European Parliament and of the Council of 31 March 2004 on setting standards of quality and safety for the donation, procurement, testing, processing, preservation, storage and distribution of human tissues and cells, a new act on human tissue donation was implemented in the German legislation in May 2007. The act came into force on August 1st 2007. The Act regulates safety and quality standards for the donation, retrieval, storing and distribution of human tissues and cells. As a result of this Act many contents about tissue transplant were regulated in different Acts. In this text only two important Acts (German Transplantation Act, German Pharmaceuticals Act) are treated substantially.
