Habermas, a postmetaphysical liberal, objects to the technologies of eugenics or genetic engineering that intervene human body. His main argument is what I call ‘Argument from Autonomy’, i.e., one that such intervention cannot be morally allowed because it can invade the autonomy the posteriors would legitimately be able to have. The two main grounds for this argument are the necessity of the contingency of one’s procreation and her content, if counterfactual, to the intervention. This article attempts to show that these grounds are not well-established and that as a result, Habermas’s argument would lose it force. Furthermore, the article attempts to suggest that his procedural conception of law might face a crisis of shifting into a new legal paradigm.
