본 연구의 목적은 스키장소속 강사이외의 사설스키레슨이 불법인지, 아니면 스키장측이 위법을 하고 있는지를 법적으로 검토하여 그 합법성 유무를 고찰하는 것이다. 고찰한 결과 본 연구에서는 다음과 같은 결론을 얻을 수 있었다. 첫째, 부모나 가족 그리고 친구동료들에 대한 비영리목적의 무보수 사설스키레슨은 합법적이라고 판단하였다. 둘째, 보수를 받는 사설스키레슨의 경우 형사법적인 측면에서 사설스키레슨강사는 스키장측이 주장하는 업무방해죄라는 형사책임이 성립되지 않으며, 따라서 사설스키레슨은 불법행위가 아니라 합법적인 행위라고 판단하였다. 셋째, 민사법적인 측면에서 `소속스키장 강사이외의 사설스키레슨 금지`규정은 약관의 규제에 관한 법률과 독점규제 및 공정거래에 관한 법률에 의해 무효규정이며 위법이므로 사설스키레슨은 적법성이 있다고 판단하였다. 마지막으로 헌법적인 측면에서 헌법 제31조 교육권과 헌법 제37조 기본권의 보장명문에 의해 스키장측의 `사설스키레슨 금지`라는 규정은 헌법에 위배되는 것이며 따라서 사설스 키레슨은 합헌적이라고 결론하였다.

The purpose of this study was to examine legality or illegality about private ski lesson except ski instructor attached to ski resort. First, private ski lesson without pay is legal. Because justification and foundation of legal sanctions and prohibition about private ski lesson of purpose for nonprofit is nothing. Second, private ski lesson as criminal law aspect is not illegal. It is legal. Because private ski lesson is not applicable to crime of interference with a ski school`s duties. Third, the regulation of private ski lesson prohibition as civil law aspect is not legal. It is illegal. Because it is applicable to unfair agreement by the Agreement Regulation Law and it is applicable to action of monopolization and abuse ski resort`s official authority about ski lesson by the Monopoly Regulations and Fair Trade Law. Finally, the regulation of private ski lesson prohibition as the constitutional law aspect is unconstitutional. Because it is illegality that it`s act violates and limit educational right and basic right of nation by Article 31 and 37 of the constitution. In conclusion, private ski lesson prohibition is illegal and unlawful act by law, private ski lesson is lawfulness, and it has to become legality in Korea ski resort.
