환경영향평가제도는 도입 이래 비약적인 발전을 해왔으며 이제는 제도적 기반 안정기에 들어섰다는 평을 받고 있다. 때문에 최근에는 환경영향평가 사후관리의 정상화를 비롯한 환경영향평가제도의 내실 있는 성장에 관심이 모아지고 있다. 본 연구에서는 이러한 시대적상황에 맞추어 우리나라 환경영향평가 사후관리 활성화를 위한 실천전략을 제안하고자한다. 환경영향평가제도의 내실을 기하기 위해 환경영향평가 사후관리가 중요한 이유는 환경영향평가제도의 독특한 특징 때문이다. 환경영향평가는 일반적인 인ㆍ허가제도와는 달리미래상황에 대한 예측에 기반하는 특성 때문에 필연적으로 불확실성을 내포하고 있다. 이런 이유로 환경영향평가제도는 사후관리를 통해 보완되고 완성되는 것이며, 사후관리과정에서 축적되는 경험과 각종 자료들을 바탕으로 환경영향평가제도의 발전을 이룰 수있다. 우선 이상적인 환경영향평가 사후관리의 형태를 도출하기 위해 관련 선행연구들과 국외사례에 대한 분석을 수행하였다. 분석결과 도출된 이상적인 환경영향평가 사후관리는 사업승인 시 맺었던 약속의 이행 확인기능, 환경영향평가 과정 및 조사결과에 대한 검증과 보정기능, 환경영향평가 사후관리결과를 바탕으로 한 기법 및 제도발전 등의 환류기능과 대내ㆍ외 간 소통을 주요기능으로 한다. 다음으로는 우리나라 환경영향평가 사후관리의 현재를 파악하기 위해 운영 현황을 분석하였다. 분석결과 협의내용 관리에 치우쳐 있는 상황과 협의내용 관리에 있어 중복업무수행 등으로 업무 효율성이 저하되는 문제를 확인하였다. 사후환경영향조사의 경우 환경현황에 대한 모니터링 역할은 어느 정도 수행하고 있으나 검증ㆍ보정기능은 미약한 상황이었다. 환경영향평가 사후관리의 중요한 기능 중 하나인 환류기능은 우리나라 제도에는 아직까지 도입되지 못한 상황이다. 이러한 현실 상황을 반영하고 기존 연구에서 제시한 개선방안과, 관계자 면담 시 제안된방안들 그리고 연구진 논의과정에서 도출한 아이디어 등을 종합하여 제도발전 방향과 실천전략을 도출하였다. 최종 목표는 이상적 환경영향평가 사후관리의 주요기능인 약속이행, 검증ㆍ보정, 환류, 소통기능이 유기적 관계를 가지며 단일 환경영향평가 사후관리체제 내에서 제 역할을 수행하는 형태이다. 이상의 최종 목표를 달성하기 위해 현실 상황 간의 간극을 고려하여 단계별 전략을 수립하였다. 단기적으로는 하위법령 및 지침 수준에서 요구되고 있는 검증ㆍ보정기능을 협의내용 관리와 사후환경영향조사의 고유기능으로 내재화하여 각각의 수준을 향상시키는것을 목표로 하였다. 중기전략으로는 협의내용 관리와 사후환경영향조사를 통합 운영하는 체제로의 발전을 목표로 한다. 이와 더불어 중기에는 검증ㆍ보정기능의 지속적 향상과 정보화개선을 목표로 하였다. 장기전략은 환류기능의 도입에 중점을 두도록 하였는데 환류기능의 법적 근거를 마련하고 피드백체계를 마련하는 것을 목표로 하였다. 최종적으로는 이들기능이 하나의 체계에서 통합되어 운용되고 환류기능을 통해 해당사업으로의 내적 환류(저감조치 개선, 조사방법 조정 등)를 비롯한 외적 환류(제도개선, 기법개발 등)를 할수 있도록 발전하는 것이 목표이다. 각 단계별로 전략에서는 법.지침 개정사항, 프로세스개선, 연구과제 등의 구체적인 준비사항을 포함하여 제시하였다. 이와 같이 본 연구에서는 우리나라 환경영향평가 사후관리의 발전을 위한 방향성을 제시함과 동시에 단계별 실천전략을 제시하고 있다. 이를 바탕으로 체계적이고 지속적인 제도개선 및 연구개발이 수행될 수 있도록 함으로써 우리나라 환경영향평가 사후관리가 바람직한 방향으로 발전할 수 있을 것으로 기대된다.

The Environmental Impact Assessment (EIA) system has made great progress since its introduction in Korea and its institutional foundation is acknowledged as having been settled. Therefore, eyes are now on the qualitative growth of the EIA system including the normalization of the EIA follow-up management. Given the context, we propose practical strategies for the vitalization and advancement of the EIA follow-up management system in this study. EIA follow-up management is important because of the unique characteristics of the EIA system. Unlike general authorization regime, the EIA is based on prediction of the future situation and is inherently subject to uncertainties. For that reason, the EIA is complemented and completed by the EIA follow-up management and the experience and data accumulated during the process contributes to the advancement of the EIA system. In this study, we first performed an analysis of relevant prior studies and cases of other countries in order to derive the ideal form of EIA follow-up management system. According to the analysis results, the ideal EIA follow-up management system includes functions to ensure the fulfillment of commitments made during project approval, verification and correction of the EIA process and investigation findings (auditing), feedback gathering to improve the analysis technique and system and internal and external communication. Next, we analyzed how EIA follow-up management is carried out in Korea to assess the current situation. In Korea, the EIA follow-up management is composed of two systems including the “of details of consultation” and “investigation of environmental impact after the fact”. According to the analysis result, Korea’s EIA follow-up management was found to be biased towards the management of details of consultation and work efficiency is undermined because the tasks are redundantly performed. In case of the investigation of environmental impact after the fact, while its function of monitoring the environmental impact has been carried out to some extent, its auditing function is not sufficient. In Korea, the feedback function which is an important component of the EIA follow-up management has not been introduced yet. By considering the above situations and reviewing the suggestions made in previous studies, recommendations made by related personnel during interviews and ideas derived during the discussion of the research team, we propose the system’s future direction and practical strategy. The final goal of the EIA follow-up management is to have the key features of the fulfillment of commitments, auditing, feedback and communication to function organically and fulfill their roles within the integrated EIA follow-up management system. We have established a step-by-step strategy to achieve the above-mentioned final objective. The short-term goal is to incorporate the auditing function stipulated in subordinate legislations and guidelines as an inherent function of the management of details of consultation and the investigation of environmental impact after the fact in order to improve the quality of each system. The mid-term goal is developing a single system which encompasses the management of details of consultation and the investigation of environmental impact after the fact. In addition, the mid-term goal is also to constantly improve the auditing function and build a better information system. The long-term goal is focused on introducing the feedback function to the EIA follow-up management system by laying the necessary legal basis and formulating a feedback system. The final aim is to integrate these features into a single EIA follow-up management system and developing a system to enable internal feedback (mitigation measures, research method adjustment, etc.) and external feedback (system improvement, technique development, etc.) via the feedback function. We suggested specific preparations such as laws and guidelines revisions, process improvements and research topics in each step of the strategy. In this study, we propose a practical step-by-step strategy while recommending the direction for the development of Korea’s EIA follow-up management system. Systematic and consistent policy improvements and research and development based on our suggestions will hopefully help the EIA follow-up management system evolve in a desirable direction.
