원자력 발전소 설비 폐쇄의 헌법적 쟁점 ― 최근 독일 연방헌법재판소 결정을 중심으로 ―

독일은 탈원전정책을 추진하면서 제1차 원전폐쇄(2002), 제2차 원전폐쇄(2011)를 단행하였고, 최근 독일 연방헌법재판소는 제2차 원전폐쇄, 즉 후쿠시마 원전사고 이후 탈원자력 가속화를 위한 일련의 입법조치가 원전 소유자 등의 재산권을 침해하는지 여부 등 중요한 쟁점을 다룬 바 있다. 먼저 대상결정에서는 외국 국가가 보유한 사법인의 청구인 능력이 문제되었고, 독일이 보유한 공법인과는 달리 이러한 경우 기본권 주체성을 긍정하였으나, 우리의 경우 원전을 설치·운영하는 주체가 한수원 밖에 없어서 한수원의 기본권 주체성이 문제될 뿐이고, 우리 헌법재판소의 판례에 비추어 보더라도 이를 인정하는 데 무리가 없을 것으로 보인다. 재산권 인정 요건에 관하여도, 독일 연방헌법재판소와 우리 헌법재판소는 유사한 입장을 취하고 있는데, 대상결정은 원자력법상의 인가나 잔여발전량, 추가발전량 등의 재산권적 성격을 부정하였고, 원전의 사용가능성 제한이 재산권을 침해하였는지 여부를 중심으로 심사하였다. 그리고 입법자에게 원자력법 형성에 있어 특별히 넓은 입법재량을 인정함으로써 기본적으로는 연방정부의 원전정책을 존중함과 동시에, 충실한 비례원칙 심사를 수행함으로써 연방정부가 간과한 재산권 침해 문제를 정확히 포착해 내고 있다. 특히 대상결정은 제13차 원자력법개정법률이 수용에 해당하는지 여부를 판단하면서 종래 해결되지 않고 있던 헌법적 쟁점에 관한 입장을 정리하였다. 즉, 기본법 제14조 제3항에 따른 수용은 언제나 재화조달을 요건으로 한다는 것이다. 이 역시 에너지정책을 추진함에 있어 정부 내지 입법자의 재량을 넓게 인정할 필요성을 반영한 것으로서 우리에게 시사하는 바가 크다고 할 것이다. 다만, 기본법 제14조 제3항에 대응하는 우리 헌법 제23조 제3항은 수용 외에 사용, 제한까지 규정하고 있어 독일의 논의를 그대로 차용하기는 어렵고, 우리의 판례가 이러한 문제를 이론적으로 정리하기까지는 시간이 더 필요할 것으로 보인다. 마지막으로 대상결정은 확정된 종료일 도입에 따라 잔여발전량을 사용할 수 없게 된 점 및 무가치하게 된 투자에 대하여 아무런 조정적 보상을 규정하지 않은 점은 재산권을 침해한다고 보았다. 이러한 재산권 침해는 탈원전의 급격한 가속화에 따른 것으로서 불필요한 사회적 논란과 비용을 초래한 측면이 있다. 우리 정부는 이처럼 급격한 탈원전이 아닌 점진적 탈원전 정책을 추진하고 있어 독일과 같은 기본권침해 문제는 피해갈 수 있을지 모른다. 다만, 에너지환경은 계속 변화하고 있으므로 추후 우리의 탈원전정책이 어떤 헌법적, 환경법적 쟁점을 낳을 것인지는 계속 지켜보아야 할 것이다.

Germany pushed ahead with the de-nuclearization policy one step ahead of us, and the German Federal Constitutional Court has dealt with important issues, such as whether a series of legislative measures to accelerate the nuclear phase-out after the Fukushima nuclear accident infringes on the property rights of nuclear power plants. First, it was questioned whether a foreign corporation owned by a foreign country has an ability to lodge a complaint, and the Court replied in the positive. But in our country, the situation is different because Korea Hydro & Nuclear Power Co. Ltd.(KHNP) is the only owner and operator of nuclear power plants. The Federal Constitutional Court of Germany ruled that the usability of the operating facilities is protected as a property rights under Art. 14 sec. 1 sentence 1 of the Basic Law. The Court acknowledged the extraordinary wider legislative discretion in the formation of nuclear power law to the legislators, and at the same time conducted a faithful review of the proportionality to accurately detect the property rights violations that the federal government has overlooked. In particular, the decision is remarkable in that the Court answered the question whether the expropriation under Article 14 (3) of the Basic Law always requires goods procurement, which has long been under controversy. The court replied in the positive because of the need to broadly acknowledge the discretion of the government or legislators in setting up the energy policy. This ruling will have a great implication for us, even though the constitutional provision of our country that provide expropriation is not same as that of Germany. Finally, the Court ruled that The 13th AtG amendment partially violates Article 14 (1) of the Basic Law because it leads to an unreasonable restriction of the rights of the complainants Krümmel, Vattenfall and RWE. This infringement of property rights was due to the rapid acceleration of nuclear phase-out, which brought about unnecessary social controversy and cost. On the contrast, the Korean government is likely to avoid this constitutional issues by pursuing a gradual policy. However, since the energy environment is constantly changing and the social debate surrounding the nuclear phase-out is not closed, it remains to be seen what constitutional and environmental-legal issues will arise in the future.
