정부의 코로나19 감염병 예방 조치에 대한 가톨릭교회의 협력: 종교 자유에 대한 권리와 국민 건강권에 대한 조화

현재 온 세계는 코로나19라는 감염병으로 불안에 떨고 있다. 아직까지 그것을 극복할 수 있는 백신도 개발되지 않았고 그 전파가 상당히 급속하기 때문이다. 이런 가운데 일부 국가들은 전 국민 이동 제한 명령을 내리기도 했다. 대한민국 정부는 이동 제한이라는 극단적 조치를 피하면서 사회적 거리두기를 국민에게 적극적으로 홍보하였고 이에 국민도 잘 호응하여 위기를 극복하고자 한다. 이런 가운데 종교 집회를 통해 코로나19에 감염된 사람들이 많이 발생됨에 따라서 정부와 지자체 단체장들은 종교 집회를 하지 말도록 강력한 권고를 내렸다. 이에 대해서 일부 종교 단체들은 헌법상 보장된 신앙의 자유를 국가가 침해한다는 이유를 들면서 집회를 강행하기도 했다. 이런 현상을 보면서 국민들은 감염병이 확산될까 깊은 우려의 마음을 갖게 되었고 그런 종파들에 대해서 따가운 비판의 시선을 가지게 되었다. 정부 입장에서는 감염병 확산 방지 및 예방이라는 목적이 있고, 종교 단체들은 신앙의 자유는 보호되어야 한다는 입장이 있는 것이다. 이런 양측의 입장에는 서로에 대한 이해와 협력의 정신이 부족해 보인다. 우선 정부 측에서 이해하고 있는 ‘종교 집회’란 그저 신앙인들이 모인 것, 곧 신앙인들이 단순하게 모인 것으로 보는 경향이 있어 보인다. 그러나 종교인들 측에서 보면, 특히 그리스도교 신자 입장에서 종교 집회, 특히 주일 예배는 개별 신앙인이 신앙을 고백하고 자신의 신에게 경배를 드리는 시간이고, 개인의 신앙을 공동체적으로 표현하는 권리이며 의무적인 사안에 속하는 주제인 것이다. 따라서 종교인들, 신앙인들 입장에서는 그 집회를 제한하거나 금지하는 것은 자신의 신앙 고백의 권리를 박탈당하는 것이라고 생각할 수 있는 여지가 충분히 있다. 그러니까 한 편에서는 신앙 고백의 자유는 절대 침해받을 수 없는 영역으로 인정하면서도 종교 집회는 질서유지와 공공복리를 위해서 제한할 수 있다는 입장을 갖고 있고, 다른 한 편에서는 내적 신앙 고백은 주일 예배를 통해 공동체적으로 실현된다고 하는 입장에서 서로 분리될 수 없는 것이기에 주일 예배를 제한하는 것은 신앙의 자유를 침해하는 것이라는 입장을 갖고 있어서 서로 충돌하는 면이 있어 보이는 것이다. 신앙 고백의 자유와 종교 집회 자유의 구별은 정부 기관의 일방적인 이해부족이라기보다 헌법학 분야 학자들의 공통된 견해이며, 헌법재판소의 판단 역시 종교적 행사, 종교 집회는 제한될 수 있다는 법률적 해석의 기초에서 출발하는 문제라고 생각한다. 다시 말해서 종교집회의 종류를 보다 세분화하여 주일예배를 위한 집회와 그 외의 집회를 구분하지 않은 상태에서, 주일예배라고 하는 내적 신앙고백의 공동체적 거행에 대한 연구와 이해가 없기 때문에 발생하는 문제라는 것이다. 그렇지만 종교 단체들도 종교의 사회적 기능을 고려할 때 국민 건강 권이라는 문제를 소홀하게 생각하지 말아야 할 것이다. 신앙의 자유가 보장되어야 하듯이 국민 건강권도 보장 되어야하기 때문이다. 이 논문에서는 코로나19라는 전 세계적 감염병 위기 상황에서 신앙인의 종교 자유와 국민 건강권의 문제를 법적 측면에서 고찰하고, 이에 대응하는 가톨릭교회의 신학적이고 교회법적인 근거를 고찰하면서 미약하나마 종교 단체들이 이런 위기 상황에서 어떤 태도를 취하는 것이 인류사회에 봉사하는 것인가를 함께 생각해 보고자 한다.

Now, fears of coronavirus disease 2019 (COVID-19) grow around the world as a vaccine against the virus is not yet developed and the COVID-19 spreads so quickly. In response, some countries have imposed nationwide restrictions on people’s movement. But the Korean government did not take extreme measures like movement restrictions. Instead, the government has promoted social distancing and encouraged its people to adhere to the government’s guidance, which the public comply with well to overcome this crisis. As we have seen a surge in new cases of the COVID-19 after many people participated in religious gatherings, central and local authorities have made strong recommendations not to hold faith-based gatherings. But some religious organizations held gatherings in defiance of government guidance, citing the state is violating freedom of belief that is a constitutional right. This made the public get agitated about spread of the coronavirus and put a blame on some sects for enforcing such gatherings. The government aims to stop transmission of the COVID-19 and prevent infection, while religious groups claim that freedom of faith should be protected. The two sides seem to need mutual understanding and collaboration. From the government perspective, ‘religious gatherings’ might be just an assembly of believers. But for people with faith, specifically for Christians, during religious gatherings, especially at the Sunday Mass, they make a profession of faith and worship their God. It is the right of believers to practice their faith as a community and this is a matter of obligation. In this regard, restrictions or bans on religious gatherings could be seen as violations of the right to profess faith. So, there is a conflict between the government and religious groups because of those different perspectives. The government makes it clear that it can put restrictions on religious gatherings for the sake of public order and welfare even though it recognizes that the freedom to profess faith should never be violated. On the other hand, religious groups stick to their view that the internal profession of faith is carried out in common at the Sunday Mass which has a unique importance, therefore limiting the Sunday Mass is a violation of religious freedom. The distinction between freedom to profess faith and freedom to hold religious gatherings does not come from the government’s unilateral decision without enough understanding, rather it comes from the common view of constitutionalists and depends on the legal interpretation by the Constitutional Court of Korea that faith-based events and religious gatherings can be limited. In other words, without enough study and knowledge, the government has no way to differentiate congregation for worship at the Sunday Mass celebrated in common with a profession of internal faith from other gatherings in general. But religious organizations should not ignore people’s right to health, considering the role of religion in our society. People’s right to health should be protected just like the freedom of faith is guaranteed, This study aims to explore legal aspects of religious freedom of believers and citizens’ right to health in this time of coronavirus pandemic and theological and canonical grounds corresponding to this issue. In addition, this study will find out what actions should be taken by faith-based groups to serve the human society in this crisis even if it is in a small way.
