크리스퍼(CRISPR)의 특허적격에 관한 연구

최근 생명공학 분야에서 가장 큰 관심을 이끌고 있는 기술은 크리스퍼다. 이처럼 크리스퍼가 각광 받는 이유는 후천성면역결핍증과 같은 난치병을 치료할 수 있는 실질적 기술로 평가되기 때문이다. 인간의 질병 정복 내지 생명연장이라는 미완의 꿈과 맞물려 크리스퍼에 대한 많은 연구가 집중되고 있으며, 그러한 연구 성과물에 대한 독점적 지위를 얻기 위한 특허출원도 뒤따르고 있다. 이와 관련하여 보다 넓은 권리범위가 인정될 수 있도록 크리스퍼를 이루는 개별적 구성요소에 관한 특허 획득을 고려할 필요가 있지만, sgRNA는 상보적 결합을 원리로 하므로 그 역할을 수행하기 위하여 필연적으로 자연물인 정상 또는 돌연변이 유전자와 동일한 서열을 취할 수밖에 없어 발명으로 성립되기 어렵고, 효소도 자연계에 존재하는 박테리아에서 추출하는 것이 생명공학 실무이므로 물리·화학적인 개변을 통하여 자연물과 현저한 차이가 발현되지 않는 한 발명으로 인정받기 곤란하므로 특허를 받을 수 없다는 점에 주의할 필요가 있다. 하지만, 이들의 복합체인 크리스퍼는 자연계에 존재하지 않는 인공적인 것이므로 발명에 해당한다. 다만, 크리스퍼는 표적 이탈이라는 의도하지 않은 기술적 문제로 인하여 공중위생을 해할 여지가 있고(특허법 제32조 후단), 인간과 이종 간의 접합체를 생산할 수 있는 실현 가능한 기술로서 인간의 존엄을 해하는 의도적 사용이 가능하므로 공서양속에 반할 수 있기 때문에 불특허사유에 해당되는지 여부가 문제된다(특허법 제32조 전단). 하지만 인간 존엄의 문제와 관련하여, 크리스퍼는 다양한 가능성을 내포한 수단에 불과한 것으로 그러한 수단이 필연적으로 생명윤리에 반하는 결과를 수반하지 않는 이상 이의 윤리성을 판단하는 것은 타당하지 않다. 나아가 일률적으로 크리스퍼가 인간의 존엄에 반한다고 보는 경우, 관련 기술의 발전을 촉진하기 어렵고, 결국 그로 인하여 인간의 질병을 치유할 수 있는 기회 또한 박탈할 수 있기 때문에 오히려 생명윤리에 반하는 것으로 볼 여지도 있다. 그리고 표적 이탈의 문제와 관련하여, 기술적 이익과 비교형량 할 필요가 있고, 부작용의 가능성·그에 따른 위해의 정도를 객관적으로 검토할 필요가 있다. 특히, 기술적 불이익은 향후 기술 발전에 따라 점진적으로 보완된다는 점도 고려되어야 할 것이다. 나아가, 발명의 기술적 불이익 내지 위험은 그러한 문제를 보완하는 또 다른 발명을 자극하고 유인함으로써 지속적으로 관련 기술의 발전을 견인할 수 있다는 점 또한 고려되어야 하며, 그것이 산업발전이라는 특허법의 궁극적 목적에 부응하는 것이기도 할 것이다.

Recently, CRISPR is the most important technology in the field of biotechnology. because it is evaluated as a practical technique for treating incurable diseases such as AIDS. In response to a lot of research is being done on CRISPR for overcoming diseases to prolong human life and patent applications for acquiring exclusive statuses on such research results is being followed. In this regard, it is necessary to consider acquiring patents on the individual components of CRISPR to obtain broader scope of rights, but sgRNAs are based on complementary binding, inevitably have the same sequence as naturally occurring gene to perform their roles. The case of mutant gene is no different. And it is a biotechnology practice to extract enzymes from bacteria in nature. Unless there are markedly different characteristics with natural products through physical and chemical modifications, enzymes as components of CRISPR are not patentable inventions. In short, sgRNAs and enzymes as individual components of CRISPR are not patent-eligible. However, CRISPR is a patentable invention as it is a artificial complex. but CRISPR has the potential to harm public health due to technical problems such as off-target(the latter part of Art. 32 of the Patent Act). And CRISPR might violate public order or sound morals because of its intentional use to undermine human dignity(the front part of Article 32 of the Patent Act). With regard to the issue of human dignity, CRISPR is merely a means of inclusion of various possibilities, and it is not reasonable to judge its ethics unless such means necessarily involve contrary results to bioethics. Furthermore, if CRISPR is consistently opposed to human dignity, it may be seen as contrary to bioethics because it is difficult to promote the development of bio-technologies, and thus also deprives people of the opportunity to cure human diseases. Regarding the problem of off-target, it is necessary to compare the technical risk with the technical benefits, and objectively examine the possibility of side effects and the degree of the risk. In particular, it should be considered that technical disadvantages are gradually made up as the technology develops in the future. Furthermore, it should also be taken into account that the technical disadvantages or risks of the invention can continue to drive the development of related technologies by stimulating another invention that complements the problems, which is in line with the ultimate purpose of the patent act.
