본고는 중국발 미세먼지 문제에 대하여 중국이 취하고 있는 국제법적 입장을 다루고자 한다. 그러기 위해서는 먼저 초국경 대기오염에 관하여 국제법상 어떤 의무가 존재하는지부터 살펴보고, 초국경 대기오염 관련 분쟁 및 협력 사례도 분석하여 이를 중국발 미세먼지 문제에 적용 가능한지 알아볼 필요가 있다. 예컨대 트레일 제련소 사건에서 캐나다가 미국에 손해배상을 해주었는데, 이를 중국발 미세먼지에도 적용할 수 있는지 그리고 미국과 멕시코 간의 환경협력체계 수립 과정에서 우리나라가 본받을 점이 있는지 살펴보아야 한다. 이러한 기본적인 내용을 바탕으로, 본고는 중국 정부의 입장과 이를 뒷받침하는 중국학자들의 연구를 분석하여, 중국이 인접국간 미세먼지 문제에 대하여 어떠한 국제법적 시각을 갖고 있는지 보여주고자 한다. 특히 2016년 중국 최초의 대기오염책임분쟁에서 중국 사법부가 중국기업에 책임을 묻는데 고려한 요소, 내용, 방법 및 절차는 중국발 미세먼지 책임문제에도 시사하는 바가 크다. 끝으로 본고는 중국발 미세먼지에 대해 한국 정부가 취할 수 있는 국제법적 대응조치를 제시하고자 한다. 비록 우리나라 정부가 실제로 채택하거나 적용하는 것은 불가능할지라도 이론적으로는 채택할 수 있는 국제법적 대응조치가 무엇이며, 어디까지가 가능한지 살펴보고자 한다.
This paper deals with the international legal position that China is taking against the fine dust problem from China. To do so, it is necessary to find out what obligations are under international law regarding transboundary air pollution. Next, this paper will analyze the cases of cross-border air pollution disputes and cooperation to see if they can be applied to the micro dust problem in China. For example, in the case of the Trail smelter, I would like to suggest if the United States is able to ask damage to Canada and that it can be applied to fine dust from China, and whether Korea can learn the process of establishing an environmental cooperation system between the United States and Mexico. Based on these basic theories, this paper analyzes the position of the Chinese government and the research of Chinese scholars who support it, and aims to introduce what kind of international legal view China has about the fine dust problem between neighboring countries. In particular, the elements, contents, methods and procedures considered by the Chinese judiciary in taking responsibility for Chinese companies in the first China's air pollution liability disputes in 2016 are highly suggestive of China's fine dust problem. Finally, this article aims to show the international legal response measures the Korean government can take against fine dust from China. Although it is impossible to adopt or apply in practice, it is theoretically possible to see what international countermeasures can be adopted and to what extent.
