현재 남한과 북한은 두 차례의 남북정상회담과 북미정상회담을 거치면서 상호긴장관계에서 평화모드로 바뀌어 가고 있지만, 아직까지도 예측불가능한 상황이 발생할 수 있는 변수는 많다. 남북정상회담에서 주요 의제 중의 하나가 남북이산가족의 상봉문제였고, 또한 최근 북한 이탈주민의 국내유입이 급증하고 있는 추세이다. 이러한 추세는 남북 이산가족 사이, 이산가족과 그들 상속인 사이, 탈북주민과 잔류자 등과의 사이에서 가족관계 및 상속 등의 분쟁을 증가시키는 원인이 되고 있다. 이를 해결하기 위해 2012년 「남북 주민 사이의 가족관계와 상속 등에 관한 법률」을 제정하여 시행하고 있다. 그러나 동법은 남북의 특수상황을 고려하여 상속과 관련한 통일적 판단기준을 제시하고 있지만, 그 개념이 구체적이고 명확하게 정의되어 있지 않고, 그 기준이나 법적 제도장치가 마련되어 있지 않는 등의 문제가 있다. 본 논문은 통일적 판단기준에 대한 구체적 해석기준을 제시하고자 하였다.

Currently, South and North Korea are shifting from mutual tension to peace mode after two rounds of inter-Korean summit and North Korea-United States summit, but there are still a lot of variables that could lead to unpredictable situations. One of the main agenda of the inter-Korean summit was the reunion of the separated families, and these days it is tend to increase rapidly the inflow of North Korean defectors into Korea. This trend is contributing to increased the family ties and inheritance disputes between separated families, separated families and their heirs, as well as between North Korean defectors and the remaining people. To resolve this issue, “Act On Special Cases Concerning Family Relationship, Inheritance, Etc. Between Residents In South And North Korea” was enacted and enforced in 2012. The same law, however, provides a unified standard of judgment concerning inheritance in consideration of the special situation between the two Koreas, there is some problem -the concept is not clearly defined and the criteria or legal system is not clearly defined. This paper intends to provide specific analytical criteria for the unified judgment criteria.
