교도소 내에서 발생하는 수용자의 다양한 문제행동은 자칫 교정사고로 이어져 교정행정의 원활한 운영을 방해하고, 수용자의 교정, 사회복귀에 부정적인 영향을 준다. 또한 수용자와 직원 그리고 직원의 가족, 나아가 사회 전체에도 해악을 미친다. 과밀수용, 교정직원의 부족, 열악한 시설 환경 등물리적 환경이 교도소 내 문제 행동을 감소시키는데 많은 영향을 미치는 것은 사실이지만, 수용자의 개별적 욕구와 특성을 고려하지 않고 단지, 시설과 제반환경만으로 교도소 문제행동을 설명하고, 이에 따라 해결방안을 모색하는 것 또한 문제의 본질을 파악하지 못하는 것이다. 이에 본 연구는 국내 범죄자 129명을 대상으로 개인적 특질을 파악하는 방편으로 국내 범죄자들을 대상으로 Hare(1991)가 개발하고, 조은경, 이수정(2008)이 번안한 사이코패스 감별도구인 PCL-R을 이용하여 이들의 정신병질을 평가하여 교도소 내문제행동을 나타내는 상습 징벌과 자해, 상습 진정 혹은 고소 남발 등이 정신병질적 특성과 어떤 관련성을 지니는지를 확인하였다. 그 결과 정신병질의 총점은 모든 상습 문제행동 지표와 유의한 관련성이 있었으며 하위요인중 대인관계/정서 특질은 진정이나 고소 횟수와 유의한 관련성이 있었으며 사회적 일탈 요인은 모든 문제행동과 유의한 관련성을 보였다. 이와 같은 결과를 고려할 때 교도소 내에서의 상습 문제행동은 수용자의 심리요인, 즉 정신병질과 통계적으로 유의한 관련성을 지닌다고 결론지을 수 있겠다.

Inmate misconduct is a universal problem in Korea as much as overseas. Misconducts in prison can have a chilling effect on a wide range of constructive prison initiatives. The problematic behaviors of inmates such as violence, suicide, escape, or possession illegal stuffs easily consequence prison accidents or emergency. After all, those behaviors exert negative influences on inmate rehabilitation, recidivism prevention, and unity of community society. Many practitioners and researchers explain the reason of inmate misconduct as insufficiency of facilities and officials. However, criminal``s individual characteristics such as psychopathy is one of the key factor that correlate misconduct in prison. For this study, we used the data from the 129 male inmates assigned to prisons over the country. We assessed the psychopathy of the inmates using Korean version of PCL-R and found the correlation between PCL-R score and experiences of general misconduct, self-injury, petition, and accusation. The finding of this study suggests good policy sense to identify inmates likely to engage in such behavior.
